Full Breakdown
Municipal Code § 4-12.02(a) lists six places where smoking is prohibited in unenclosed areas: recreational areas; service areas; dining areas; places of employment; property owned and operated by the City of Huntington Park, including all City facilities and vehicles; and other public places while in use for a public event such as a farmers' market, parade, fair or festival. Streets and sidewalks used in a traditional capacity as pedestrian or vehicular thoroughfares stay permitted under the public event clause unless the chapter or other law prohibits smoking there.
The definitions in § 4-12.01 set the reach. A recreational area includes parks, picnic areas, playgrounds, sports courts and fields, golf courses, walking paths, gardens, hiking trails, bike paths, swimming pools, skateboard parks and the parking facilities pertaining to them. A dining area is any area, including streets and sidewalks, designed, established or regularly used for consuming food or drink, which brings restaurant patios under the ban. A service area includes bus stops or shelters, ATMs, ticket lines, mobile vendor lines and cab stands. Smoke includes tobacco smoke, electronic cigarette vapors and marijuana smoke. A reasonable distance means 20 feet in any direction from an area where smoking is prohibited and 25 feet from playgrounds and tot lots.
Section 4-12.03 bars smoking in any unenclosed area within a reasonable distance of any doorway, window, opening, crack or vent into an enclosed area where smoking is prohibited, except while actively passing on the way to another destination. Section 4-12.04 bars disposing of used smoking or tobacco product waste inside a prohibited area, including inside the reasonable distance, and makes each instance of smoking a separate violation. Section 4-12.05 requires a clear No Smoking or similar sign at each point of ingress and at one other conspicuous point, with letters at least one inch high, the international symbol, and at least one sign carrying the Police Department phone number. Under § 4-12.02(b), any owner with legal control can prohibit smoking on its property even where the chapter does not.
Violations & Fines
Each incident of smoking or tobacco product use in violation is an infraction subject to a $100 fine (§ 4-12.06(b)). The City Prosecutor can charge other violations as infractions or misdemeanors. The Huntington Park Police Department enforces the chapter, and any peace officer, business license officer or code enforcement official can too. The City can also bring a civil action for a fine not less than $250 and not exceeding $1,000 per violation, and the City Attorney can seek nuisance abatement or injunctions.
