44 defines its territory broadly. "Public recreational areas" cover any unenclosed City-owned or operated space used for recreation or special events, parks, playgrounds, sports fields, swimming pools, trails, campsites and walking paths, to which the public is invited or permitted. "City facility" reaches beyond buildings to any balcony, courtyard, deck, parking lot, parking garage, patio or walkway that the City owns, maintains, operates or leases for more than occasional use, and "City workplace" covers any floor-to-ceiling enclosed work area or vehicle the City owns, maintains, operates or leases where employees are assigned to work.

020 defines "smoking" broadly enough to include electronic smoking devices and vaporizers alongside cigarettes, cigars, hookahs and pipes. 030 prohibits smoking across all three categories of space, except where State or Federal law already prohibits it more narrowly, those laws control instead. 040 lets the City Manager designate limited smoking areas notwithstanding the general ban. 050 requires "Smoking" or "No Smoking" signs to be posted, but the absence of a sign is not a defense to a citation. 060, responding to complaints or acting on their own observations.

010: up to $100 for a first violation, up to $200 for a second violation of the same provision within a year, and up to $500 for each further violation within that year. 070(C) separately declares any violation a public nuisance.
