Lakeville, MN Public Conduct: Outdoor Smoking Restrictions (2026)

Lakeville City Code § 7-1-7 prohibits smoking in all city parks, extending the ban to public parking lots adjacent to city parks and to the inside of any motor vehicle located in a park or its adjacent public parking lot. The definitions in § 7-1-1 give the ban real reach: "smoking" covers inhaling, exhaling, burning or carrying any lighted or heated cigar, cigarette, pipe or other product containing or derived from nicotine, cannabis, hemp or another plant intended for inhalation, and the definition expressly folds in the use of an "electronic delivery device," meaning e-cigarettes, e-cigars, e-pipes, vape pens, mods and tank systems are all treated the same as a lit cigarette for purposes of the park ban.

Because the prohibition reaches a vehicle parked inside a city park or its adjacent lot, a driver cannot avoid the rule simply by staying inside the car with the windows up. The section was adopted by Ordinance 1082 on August 7, 2023, and amended the same day by Ordinance 1083, replacing older, narrower park smoking language with this broader ban covering vaping devices for the first time. A violation is a petty misdemeanor under subsection B, the same grade of offense the city uses for other park violations like the loading zone rule elsewhere in the code, rather than the ordinary misdemeanor that applies to city code violations generally under § 1-4-1.
