Morgan County, IN Public Conduct: Outdoor Smoking Restrictions (2026)

Morgan County Code § 30.08 bars smoking and vaping on the property of the County Administrative Building and Judicial Campus outside of designated smoking areas. The county has set aside one designated smoking and vaping area in the parking area for that campus, equipped with seating and a disposal receptacle, and the Board of Commissioners may designate additional areas at its discretion. Signage must be posted conspicuously near entrances and around the campus stating that smoking and vaping are prohibited except in the designated area or areas.

The section does not override other applicable state or local laws that are more restrictive, so businesses and other public property in the county are not automatically covered by this rule; it applies specifically to the county's own administrative and judicial campus. Enforcement runs through § 30.99(E): a first violation draws only a verbal warning, but a person who is warned and refuses to stop smoking or vaping outside the designated area is treated as trespassing and can be removed from the property. Anyone who smokes or vapes outside the designated area is guilty of an infraction, fined on an escalating schedule: not exceeding $50 for a first infraction, not exceeding $100 for a second, and not exceeding $250 for a third or any later infraction.

Repeated violations can result in the Commissioners permanently barring the violator from the property as a trespasser. The current version was last amended by Ord. 2024-26, passed November 18, 2024, which updated the original 2005 smoking policy to add vaping.
