California state law bans smoking in most outdoor public spaces near children, workplaces, and state parks, and San Bernardino County applies these rules in unincorporated parks and public buildings.
California Government Code section 7596 bans smoking inside government buildings and within 20 feet of entrances. California Health and Safety Code section 104495 prohibits smoking and vaping in state parks and beaches, and similar rules apply on county playgrounds, in regional parks, and at trailheads in unincorporated San Bernardino County. The county also enforces no-smoking rules near childcare facilities, public transit stops, and within multi-unit common areas. High Country and desert fire-zone rules tighten outdoor smoking during red flag warnings.
Smoking near banned areas can produce infraction citations, and igniting tobacco in declared fire zones can escalate to misdemeanor or restitution exposure.
