035, adopted by Ordinance No. 2329 on February 3, 2015, states plainly that smoking shall be prohibited in all city parks, on sports fields, in recreational areas, and at all adjacent parking areas. 010(3) as the carrying or holding of a lighted pipe, cigar, or cigarette of any kind, or any other lighted smoking equipment or the lighting or emitting or exhaling the smoke of a pipe, cigar, or cigarette of any kind, so the ban reaches vaping devices and any other lit tobacco product used outdoors on park grounds.
050. 035 targets outdoor park property specifically, it applies even though those other sections are limited to enclosed spaces. 070 must be posted with letters at least one inch tall, or the international no-smoking symbol, at any building or place where smoking is controlled by the chapter. 080, and any resident may file a complaint to trigger enforcement; a violation is also declared a public nuisance that the city or any affected resident may abate through a restraining order or injunction.
