Shelby, MI Public Conduct: Outdoor Smoking Restrictions (2026)

Chapter 170's disorderly conduct list of unlawful acts, amended in its entirety on March 23, 2026 by Ordinance No. 05-26, defines smoking in § 170-1 as inhaling, exhaling, burning, vaporizing or carrying any lighted cigar, cigarette, pipe, weed, or plant, with an exception for religious ceremony or observance. Subsection O of § 170-2 then makes it unlawful to smoke in any public park within the village except as otherwise designated as a smoking area from time to time by the village, meaning the village retains discretion to carve out specific smoking zones within its parks rather than an absolute ban on every square foot.

The prohibition is narrower than a full public-place smoking ban: it targets parks specifically, not the sidewalks, streets, or business entrances also covered by the chapter's broad definition of public place, so smoking on a downtown sidewalk is not reached by this particular subsection even though other subsections of § 170-2 govern conduct in those same public spaces. Because the smoking clause is folded into the general list of unlawful acts in § 170-2, alongside indecent conduct, loitering, prowling and disturbing the peace, it is enforced identically to those other listed offenses rather than through a separate health-code smoking ordinance.
