Sun Prairie, WI Public Conduct: Outdoor Smoking Restrictions (2026)

010 first adopts Wisconsin's statewide smoking ban, Wis. 123, by reference for the City of Sun Prairie, then layers on a locally defined version of "smoking" that supersedes the state definition for enforcement here: it covers lit or heated cigarettes, cigars and pipes, plus electronic smoking devices defined broadly enough to include vape pens, mods, tank systems and e-hookahs, whether they produce smoke, mist, aerosol or vapor. Subsection D adds the city's own prohibited-conduct list, separate from whatever the state ban already covers indoors: smoking is prohibited in all city parks, in all city-owned and operated buildings, and in buildings or portions of buildings the city leases and operates, plus every city-owned or leased vehicle.

020, repeats the building- and vehicle-level ban with its own lower forfeiture. 010(E) bars chewing or smoking tobacco products, and even possessing an electronic smoking device, in a school building or on school grounds, a stricter standard than the general park and building rule. The city police department is designated as the enforcement agency for the chapter. Because Sun Prairie's park ban is a local addition layered onto the statewide ban rather than a freestanding general outdoor smoking law, it reaches city parks and city facilities specifically; it does not, on its own, extend to purely private outdoor spaces such as restaurant patios, which remain governed by the state statute the city adopted by reference.
