Vineland, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Vineland City Code § 660-11 makes it unlawful to smoke or use tobacco products on public property upon which a public building or improvement open to the public is constructed, and separately bars smoking anywhere on the grounds of municipal buildings and improvements, including contiguous City-owned, leased, rented, or operated properties, regardless of whether a building sits on that parcel. The Article II definitions in § 660-10 sweep broadly: SMOKING covers burning, inhaling, exhaling smoke from, or even possessing a lighted cigar, cigarette, cigarillo, or pipe containing tobacco, and MUNICIPAL BUILDINGS AND IMPROVEMENTS reaches every structure the City owns, leases, rents, or operates that is open to the public or to which the public may be invited.

Enforcement under § 660-12 falls to the Health Officer, the Police Department, and/or the Recreation Commission, or any other person charged with enforcing City ordinances; obstructing or verbally abusing the Health Officer or a Recreation Commission member carrying out this duty is itself a separate violation, and citizens may file complaints against violators. Penalties escalate under § 660-13: a fine of not less than $50 and not exceeding $100 for a first offense, not less than $100 and not exceeding $200 for a second offense, and not less than $200 and not exceeding $500 for a third offense, all imposed upon conviction.

This article, adopted 2-25-2014 by Ord. No. 2014-12 and amended 10-13-2020 by Ord. No. 2020-46 to add vapor products to some related sections, is distinct from Vineland's separate electronic-smoking retail licensing provisions in Article I of the same chapter.
