Vineland, NJ Public Conduct: Public Marijuana Use (2026)

Chapter 266, Article I, adopted July 13, 2021 by Ordinance No. 2021-42 and amended through 2024, regulates cannabis establishments licensed under the state Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act. Section 266-2H bans consuming cannabis, cannabis products and items, in any form or manner, in any public place within the City of Vineland, borrowing the definition of public place from the city's own Land Use Ordinance (Chapter 425) and from the state Act, and expressly extending to the definition of indoor public place in N.J.S.A.

26:3D-57. The provision goes further than a bare cross-reference: it states the ban applies notwithstanding any provision to the contrary, and it reaches any place privately owned or operated on a for-profit or nonprofit basis that is generally accessible to the public, not just government-owned property. The same section sets separate operating rules for licensed retailers: no cannabis retailer may open to customers before 8:00 a.m. or remain open after 10:00 p.m., and establishments must control odor with carbon-filtered ventilation and control noise from outdoor equipment with baffles and mufflers.

Licensing itself runs through the Cannabis Advisory Committee under § 266-3, which caps the City at two Class V retailer licenses and two Class VI delivery licenses, and no local license takes effect until the state Cannabis Regulatory Commission issues its own permit. Section 266-2A makes clear that if any part of the local rule conflicts with state statute or regulation, the state rule controls.
