Summary

Waterbury bans smoking on public streets, sidewalks and rights-of-way inside a defined downtown zone bounded by Baldwin, Union, Scovill, Cole and South Elm Streets. City Code § 96.163 makes lighting or carrying a lit cigarette, cigar or pipe there a public nuisance, enforced by police citation and fines set in the annual budget.

It is hereby declared a public nuisance for any person to smoke, or to otherwise carry or use any tobacco product while it is lit or ignited, in or on any public right-of-way, public street or public sidewalk within the smoke-free zone herein defined and smoking, and the carrying of or use of any tobacco product while it is lit or ignited, in said smoke-free zone is prohibited. Any person smoking, or carrying of or using any tobacco product while it is lit or ignited, in said smoke-free zone shall be in violation of this subchapter.
