Wylie, TX Public Conduct: Outdoor Smoking Restrictions (2026)

Sec. 74-183(a) makes it an offense to smoke or possess a burning tobacco product, tobacco substitute, weed, other plant product, electronic cigarette or liquid nicotine in listed indoor and enclosed areas, including city buildings, facilities and parks, any retail or service establishment serving the public, enclosed areas of businesses and nonprofits open to the public, public restrooms and elevators, and within 15 linear feet of the entrance of any facility where smoking is banned. Subsection (c) extends the ban outdoors: smoking is prohibited on a retail or service establishment's outdoor patio that is defined by a barrier or provides seating when any part of that patio sits fewer than ten linear feet from public property, another establishment's patio, or an operable window into a building.

Subsection (d) lets an owner or operator voluntarily declare an entire establishment nonsmoking, and subsection (e) requires posted signs stating smoking is prohibited and that violating it is punishable by a fine not to exceed $2,000.00; subsection (f) makes the absence of that posted notice a defense to prosecution. Subsection (g) exempts private residences, hotel and motel rooms rented to guests, licensed smoking rooms and lounges in retail tobacco or e-cigarette stores meeting ventilation standards, unenclosed outdoor seating areas away from playgrounds, stage productions, and golf courses between the first tee and 18th green.

Code enforcement, police and other city officials designated by the city manager enforce the article under Sec. 74-184, and the building official may order a noncompliant smoking room or lounge closed until it demonstrates compliance.
