Summary

The Town of Babylon bans drinking or carrying an open container of alcohol on any public street, sidewalk, park or town-owned property in Suffolk County, with permits available only for approved organized events.

It shall be a violation of this chapter for any person to: A. Consume any alcoholic beverage in any public place within the Town. B. Have in his possession an open or unsealed container of an alcoholic beverage while in any public place.

Town of Babylon Code § 74-3 makes it a violation to consume alcohol or carry an open or unsealed container of an alcoholic beverage on any highway, street, sidewalk, park, recreation area or town-owned building anywhere the town code reaches. The Town Board adopted the ban in 1983 after finding that open-container possession in public led to intoxication, disorderly conduct and property damage. Organizations may seek written permission in advance from the Town Board for an exception, and the beach areas are instead governed separately under the Town Board's own conditions.
