Bulloch County, GA Public Conduct: Public Alcohol Use (2026)

Bulloch County Code Section 3-164, part of the alcoholic beverages chapter, states in subsection (a) that beverages sold for on-premises consumption must be consumed only on the licensed premises, and licensees are responsible for ensuring no one removes them in any container. Subsection (b) extends the same prohibition to the public generally: it is unlawful to drink or possess an open container of any alcoholic beverage on any public street, sidewalk, park or other public place in the county, or inside any motor vehicle located on those streets, sidewalks, parks or public places.

' Enforcement in the unincorporated area falls to the Bulloch County Sheriff's Office, which can cite a violator directly under the ordinance rather than through a licensee's alcohol permit. Chapter 3's own penalty section, Sec. 00, imprisonment in the county jail for up to 60 days, or both, and Sec. 1-11(b) separately provides that each day a violation continues is a separate offense. Because Statesboro, Brooklet, Portal and Register each administer their own municipal codes, this county rule governs only outside those city limits; a container legal to carry inside Statesboro's downtown district can still be an open-container violation once the same street crosses into unincorporated county territory.
