Colonie, NY Public Conduct: Public Alcohol Use (2026)

Chapter 48 states its purpose up front in § 48-1: the Town of Colonie must control alcohol use in public places to prevent disorder, nuisances, littering, and other harm to residents' health, safety, and welfare. The operative ban sits in § 48-3A: no person may consume alcoholic beverages in or on any public place, a term § 48-2 defines broadly to include any highway, street, road, sidewalk, lane, public parking lot, shopping area, place of amusement, playground, park, beach, or other publicly owned land in Town, but not the interior of premises licensed to sell and serve alcohol on-site.

Section 48-3B separately bars breaking, leaving, or discarding any bottle, can, or container in a public place unless it goes into a trash receptacle. Three carve-outs exist: § 48-4A allows drinking in a Town park, playground, or other Town-controlled public area consistent with the Town's Recreation and Parks Law (Local Law No. 6-1978); § 48-4B exempts any fair, picnic, or community special event, including a block party, for which the Town Clerk issued a special permit under § 48-5; and licensed premises fall outside the § 48-2 definition entirely. Section 48-7 makes any inconsistent state or federal law control over this chapter.
