Farmersville, TX Public Conduct: Public Alcohol Use (2026)

City Code Sec. 5-54 makes it unlawful to consume any alcoholic beverage on a public street or alley, or on a public place adjacent to a street or alley, anywhere in Farmersville. The section carves out a person's own private residence, including an attached patio or balcony, as not being a public place, so drinking on your own porch is not covered. Separately, under a Texas Alcoholic Beverage Commission order dated on or about August 10, 2014, it is unlawful to possess an open container or publicly consume alcohol within the city's designated central business district, as that district is mapped in Chapter 47, Article IV, Division 4.

Two exceptions apply city-wide: consumption is lawful inside the premises or patio of a private club holding a valid TABC liquor permit and a valid city alcoholic beverage permit, and consumption is lawful at a properly permitted special event where the alcohol is sold by a TABC and city permit holder and the drinking area is enclosed with secured ingress and egress and covered by a roof. Chapter 5 also regulates hours of sale (Sec. 5-55, tracking state law) and bars alcohol sales within 300 feet of a church, public or qualifying private school, hospital, or day care center (Sec. 5-84), and prohibits sales entirely in residential areas (Sec. 5-85), with a council variance process available under Sec. 5-86 after a noticed public hearing.
