Full Breakdown

02 lists three prohibited-consumption zones. First, any public street, way, alley, or public parking lot is off-limits for drinking at any time. Second, public parks are off-limits except during a special event that the City sponsors or co-sponsors, meaning a permitted festival or similar City event can lawfully serve alcohol on park grounds while an ordinary picnic cannot. Third, the ban reaches private property too: drinking within 100 feet of a public way on private land that is open to public view is prohibited unless the property owner, the owner's agent, or the person in lawful possession expressly permits it, closing off the porch-in-view-of-the-street loophole.

The section closes with a savings clause stating it does not make punishable any act already prohibited under California law, so it layers on top of, rather than replacing, state open-container and public-intoxication statutes. 01 offenses (committing acts like unauthorized entry onto private property while intoxicated) are misdemeanors. The ordinance traces to Ord. 176 Section 1 (1983) and was amended by Ord. 318 Section 1 (1993).

Violations & Fines

Drinking on a public street, alley, parking lot, in a park outside a City-sponsored event, or within 100 feet of a public way on visible private property without the owner's consent is an infraction under Sections 4-3.02 and 4-3.03, cited separately from the misdemeanor intoxication offenses in Section 4-3.01.

Frequently Asked Questions

Can I drink a beer in a Hercules park?
Not ordinarily. Section 4-3.02(b) bans consuming alcohol in any public park, with the sole exception of special events that the City sponsors or co-sponsors, such as a permitted festival.
Is drinking on my own front porch in Hercules illegal?
It can be. Section 4-3.02(c) bans drinking within 100 feet of a public way on private property that is open to public view, unless the owner or lawful occupant expressly permits it, so a visible front porch near the street is covered absent that permission.
Is an open-container violation in Hercules a misdemeanor?
No, it is only an infraction. Section 4-3.03 makes violating the drinking-location ban in Section 4-3.02 an infraction, reserving misdemeanor charges for the separate intoxicated-conduct offenses listed in Section 4-3.01.
