Hudson, NH Public Conduct: Public Alcohol Use (2026)

Hudson's ban on public drinking dates to Ordinance No. 73, adopted by the Board of Selectmen on September 7, 1977, and now sits in Town Code Chapter 158, Article I, Public Places. Section 158-1 makes it unlawful to drink any alcoholic beverage or alcoholic liquor, as defined in RSA 175:1, on a public highway, public sidewalk, municipal parking lot, the Town of Hudson Common, or any other town property. The prohibition covers the entire town, not just downtown or park areas, and applies regardless of whether the drinker is a resident or a visitor crossing over from Nashua on the Sagamore Bridge or Taylor Falls Bridge.

Section 158-3 lets the Board of Selectmen and the Police Department grant written exceptions on a case-by-case basis, available to anyone who requests one; groups organizing a block party, fundraiser or town event on public property should secure that written approval before serving alcohol. A second, separate rule in Article II bars alcohol at Hudson's ballfields entirely: Section 158-4, rewritten in its entirety on September 15, 2020, makes it unlawful to sell, use, or possess any alcoholic beverage at or on a Hudson ballfield or its parking area, whether the field is publicly or privately owned, unless the Town permits it on a case-by-case basis.

Both articles carry their own penalty clause. A first Article I offense, and every one after it, draws a fine of not more than $100 and not less than $25 under Section 158-2, and an Article II ballfield violation carries the identical $25-to-$100 range under Section 158-5. The Hudson Police Department is the enforcing agency for both articles.
