Hutto, TX Public Conduct: Public Alcohol Use (2026)

Hutto Code of Ordinances § 18.02.002(a) makes it unlawful and a class C misdemeanor to consume any alcoholic beverage, or to possess an open container holding any amount of alcohol, in designated parking areas or within 25 feet of either side of a roadway within a city-owned public park inside the city limits. Alcohol is separately prohibited outright at any organized youth sports activity or program on city park property, and any event wanting to sell alcohol using public park facilities must meet Texas Alcoholic Beverage Commission requirements as set by the city's special event request form processed through the police department.

Subsection (b) bans glass beverage containers entirely in all city parks and sports facilities, defining 'glass container' broadly as any receptacle made wholly or partly of glass designed for storing or consuming food or drink; this glass ban is not limited to the 25-foot roadway buffer and applies park-wide. Under § 18.02.002(j), any violation of the section is a misdemeanor punished under the general fine in § 1.01.009, and subsection (k) allows exceptions only with city council approval.
