Summary
Pottstown Borough Code § 202 makes it unlawful to possess an open container of, or drink, liquor, wine or beer on any public sidewalk, street, alley, park or other public place in the Borough, unless Borough Council has given written permission for use on Borough property or the location is a permitted outdoor dining area.
No person shall have on or about his person, possess, carry or transport liquor, wine, beer or other alcoholic beverages in open containers in or about any public sidewalk, street, alley, walkway, public park or playground, or any other public place in the Borough. No person shall drink or consume liquor, wine, beer or other alcoholic beverages in or upon any street, sidewalk, alley, walkway, public park or playground, or any other public place in the Borough except as hereinafter provided. ... Any person who shall violate any provision of this Part shall, upon conviction, be subject to a fine of not less than $25 nor more than $600, together with costs of prosecution for the violation, or, in default of payment thereof, to suffer imprisonment for not more than 30 days.

Chapter 6, Part 2, Alcoholic Beverages, of the Pottstown Borough Code prohibits both possessing an open container and drinking alcohol in public. Section 202(1) bars anyone from having liquor, wine, beer or other alcoholic beverages 'on or about his person, possess, carry or transport' in open containers on any public sidewalk, street, alley, walkway, park, playground or other public place in the Borough, and separately bars drinking or consuming alcohol in those same locations. 'Open' is defined in § 201 as a container whose cap, cork, top or seal has been removed, punctured or pulled, and 'on or about the person' reaches anything close enough for the person to reach without materially changing position.
The Part carves out two paths to lawful public drinking. Under § 202(2) and (3), Borough Council can permit possession and consumption on Borough-owned property under regulations it adopts, but an individual event or use still needs written permission from Council or its authorized representative; going without that written permission is itself a separate violation under § 202(4). Separately, § 205, added in 2019 by Ordinance 2184, exempts outdoor dining areas defined in the Zoning Chapter's § 1400 that hold a valid Borough permit, so long as patrons stay within the area's confines and do not carry an open drink off the licensed premises.
Outside a Council permit or a permitted outdoor dining area, an open container or public drinking anywhere in the Borough, sidewalks, streets, alleys, parks and playgrounds alike, violates § 202.
