Trenton Code § 10-18, added to Chapter 10 by Ordinance No. 17-75 in 2017 as Article V, Consumption in Public, bars two things: Subsection A prohibits consuming or possessing, in any open container, any alcoholic beverage in or upon any public or quasi-public place, including but not limited to any public street, alley, sidewalk, mall, park, playground, public conveyance or parking facility, or in any public building. Subsection B separately bars consuming alcohol in a private vehicle while it is in motion or parked on such a public or quasi-public place.
Section 10-19 carves out five exceptions: drinking on premises licensed to serve alcohol; carrying beer in pitchers or other unsealed containers from a licensed premises while in transit to a lawful consumption site; possession or consumption at a City park, recreation area, or public building event that has a state Division of Alcoholic Beverage Control permit; the same activity at a City-owned park or building under a City Council resolution authorizing it in advance; and an underage person consuming alcohol during a religious observance in the presence of a parent, guardian, or relative age 21 or older.
Violations are punished under § 10-20 by the Chapter 1 general penalty: a fine of up to $2,000, imprisonment in the county jail for up to 90 days, or up to 90 days of community service.
