Trenton, NJ Public Conduct: Public Urination (2026)

Trenton Code § 201-8, adopted in 1967 as former § 3-31 of the Revised General Ordinances, prohibits urinating, defecating, or placing any bodily waste on any street, sidewalk or other place in public view or to which the public is invited or has access, and requires use of proper lavatory, toilet or similar facility instead. The provision is not limited to streets and sidewalks by name; the in-public-view and public-access language sweeps in parks, parking lots, alleys, and any other outdoor or semi-public space where the act would be visible or the location is open to the public, covering conduct on both public and privately owned but publicly accessible property.

Article III of Chapter 201, Peace and Good Order, contains only this single operative section plus its penalty clause; there is no separate fee, permit, or exemption built into the article. Violations are punishable under § 201-9 as provided in the Chapter 1 general penalty at § 1-17: a fine of up to $2,000, imprisonment in the county jail for up to 90 days, or up to 90 days of community service, with repeat offenders under § 1-19 facing an additional fine layered on top of the fine for the underlying offense, and each day a violation continues counted as a separate offense under § 1-18.
