The ordinance grew out of the City Council's 2021 decision, in Ordinance No. 2295-21, to prohibit cannabis dispensaries citywide while allowing other categories of licensed cannabis businesses under an annual permit, a choice New Jersey law expressly leaves to each municipality. Because the consumption restriction reaches "elsewhere in the City of Passaic," it functions as a general public-consumption ban, not merely a rule for licensed premises, and a resident's only lawful place to consume is inside a private residence.
