Tracy, CA Public Conduct: Public Marijuana Use (2026)

Section 6.36.270, in the Commercial Cannabis Activity chapter, puts the duty on the permit holder rather than directly on the consumer: no cannabis business permittee shall allow any person to smoke, ingest, or otherwise consume cannabis or cannabis products in any form on, or within twenty feet of, the premises. That twenty-foot buffer applies at every licensed cannabis business type in the city: storefront retailers, non-storefront delivery retailers, cultivation sites, manufacturers, distributors, microbusinesses, and testing laboratories.

The chapter reinforces the rule with mandatory signage. Cultivation, manufacturing, distribution, and testing-lab sites must post a sign reading that smoking, ingesting, or consuming cannabis or cannabis products on the site or in a public place is prohibited, displayed at least eight by ten inches, in a conspicuous place, at all times. Storefront dispensaries carry the same signage duty under section 6.36.380(l)(i).

Tracy's code does not separately criminalize cannabis consumption in city parks, sidewalks, or other open public space the way it does at licensed cannabis sites; that broader public-consumption restriction is governed by state law, primarily Health and Safety Code section 11362.3, which bars smoking or consuming cannabis in any public place. Locally, the twenty-foot buffer around a permitted cannabis business is enforced as a permit condition: allowing consumption within it is grounds for permit suspension, modification, or revocation under section 6.36.090, and every violation of Chapter 6.36 is separately deemed a public nuisance under section 6.36.450.
