Lee's Summit, MO Public Conduct: Public Urination (2026)

Sec. 17-189 makes it unlawful to urinate or defecate 'in public, or on a place which the public is invited or has access,' outside of a toilet, urinal or commode located in a restroom, bathroom or other structure enclosed from public view. That wording reaches more than open streets and parks: it covers any location where the public is invited or has access, including parking lots, alleys, business exteriors and outdoor event grounds, not just designated public property. The ordinance carves out two narrow exceptions in Subsection B: children five years old or younger, and a person of any age with a verified medical condition that leaves them without full control of the bodily functions governing urination or defecation.

Unlike most of the offenses in this chapter, Sec. 17-189 sets its own dedicated penalty rather than deferring to the Code's general fine, capping punishment at $150 and 30 days, both of which are lower than the Code's default $500/90-day maximum for ordinance violations lacking a specific penalty. The section was added by Ordinance No. 8068 in January 2017 as part of a broader recodification of Chapter 17's public-morals offenses.
