Full Breakdown
Section 10.06.030 of the Aliso Viejo Municipal Code treats skateboards the same way as bicycles, roller skates, roller blades and scooters. Anyone riding in the City of Aliso Viejo can use a sidewalk at a speed not to exceed five miles per hour, and subsection (B) adds that the speed must be reasonable or prudent given weather, visibility, pedestrian and vehicular traffic, and the surface and width of the sidewalk. A rider must yield the right-of-way to every pedestrian and must also yield to all traffic when entering a roadway or driveway.
The business district limit is the broadest: sidewalks within a commercial or business center or complex are closed to skateboards. The same list closes sidewalks next to a public school building while school is in session, sidewalks and parking lots next to or within a community or recreation center when it is in use, sidewalks next to a church during services, every parking lot on property owned or operated by the city, and any pedestrian overcrossing or other sidewalk where a posted sign prohibits riding. The Public Works Director can declare additional stretches of sidewalk off limits and must erect and maintain signs showing those limits. Wheelchairs and other power-driven mobility devices used as a mobility aid by a person with a disability are carved out and can use all sidewalks at the speed of pedestrian traffic.
The roadway is a separate rule. Under section 10.06.040, no one can ride a nonmotorized skateboard on the roadway of any street in the city, or cause or permit it to roll or coast there. The one exception covers cul-de-sacs where the length of the cul-de-sac is 500 feet or less. Inside city parks, section 11.10.140 bars skateboards except in areas designated, and under conditions established, by the Community Services Director.
Violations & Fines
The cross-reference at the end of Chapter 10.06 sends penalties to Chapter 1.06. Under section 1.06.010 a violation is a misdemeanor, punishable by a fine of not more than $1,000, imprisonment of not more than six months, or both, unless the city attorney or other prosecutor treats it as an infraction. An infraction carries a fine not exceeding $100 for a first violation, $200 for a second violation within one year, and $500 for each additional violation within one year. Section 1.06.020 makes each day a violation continues a separate offense. A violation inside a city park also exposes the rider to eviction under section 11.10.030.
