Texas Transportation Code does not include skateboards in the definition of vehicle or bicycle, so under Section 552.006 skateboarders may be required to use sidewalks but not roadways and are prohibited from interstates. Harris County Commissioners Court has adopted park rules under Local Government Code Chapter 320 that limit skateboarding inside Precinct parks to designated skate parks (Burnett Bayland, Tom Bass, El Franco Lee). Skating on park benches, ledges, plazas, and historical monuments is prohibited. Inside Houston, Code of Ordinances Chapter 28 bans skateboarding on downtown sidewalks (Central Business District), in parking garages, and where posted by property owners. Helmets are not mandated at the county level.
Skating in prohibited park areas is a Class C misdemeanor with fines up to $500. Houston downtown skating violations carry fines up to $500. Damage to plaza features adds criminal mischief charges under Penal Code 28.03.
