34 governs any area the city council designates by resolution as a skate park for exclusive skateboard and rollerskate use. 050. 040 lists the operating regulations: no skateboarding or rollerskating outside the posted hours of operation; no use of the park for anything other than skateboarding and rollerskating; no use without the posted safety equipment; no riding or allowing a bicycle on the skating surface; no using or being under the influence of alcohol or drugs while using the park; no littering or placing trash or debris on the skating surface, with a requirement to use designated trash receptacles or face removal from the park; no vandalism of any kind, including graffiti, tagging, stickers or decals, on park facilities; and skaters must stay on the skating surface itself, not the curbs and driveways of the surrounding city-owned area.

050 sets the penalty: a violation of any provision of the chapter is an infraction, though the city or district attorney has discretion to instead file it as a misdemeanor, and the complaint must specify which charge applies. Each day a violation continues counts as a new and separate offense, so an ongoing violation, such as riding without required safety equipment day after day, can compound into multiple separate charges.
