Waterloo, IA Public Health Rules: Rodent Control (2026)

The Waterloo City Council regulates outdoor trapping under City Code section 5-1-5, part of the animal control chapter enforced by the Waterloo Police Department's animal control division. The baseline rule bans setting or using any steel, claw, leghold, conibear, snare or box trap outside of a structure or building to take, kill, maim, wound, ensnare or capture an animal, or any trap injurious to persons or animals. Six exceptions carve out lawful trapping. A governmental unit may trap animals creating a public nuisance or threatening public safety.

Licensed pest and rodent control operators may trap in protection of private property. During the state conservation commission's open season, furbearing animals may be trapped on privately owned parcels of 40 acres or more, or on public land with agency authorization. Wire cage box traps may be used to remove nuisance pests from private property, but the traps must be checked every 30 minutes. Animal control also rents traps for a five day period to remove nuisance pests, though any trapped dog or cat must be transported to the Humane Society and any wildlife released unharmed outside city limits.

The exception most relevant to homeowners is subsection F: a private property owner may trap on his or her own private property specifically to control small rodents such as gophers, moles and other similar animals, without needing a pest control license. The chapter sets no distinct penalty for section 5-1-5, so a violation, such as using a banned leghold trap or leaving a wire cage trap unchecked, falls to the code's general penalty in section 1-3-1: a fine and jail term capped at the maximum for a simple misdemeanor under Iowa Code section 903.1(1)(a).
