Inspections may be conducted for one or more of the following basis: a) An area basis... b) A complaint basis, such that complaints of violations will be inspected within a reasonable time. c) A recurrent violation basis, such that those premises which are found to have a high incidence of recurrent or uncorrected violations will be inspected more frequently.
Full Breakdown
401 et seq. Subsection 7(1) requires the Director of Building and Zoning or authorized staff to inspect regulated premises periodically, with the gap between inspections capped at two years unless the most recent inspection found no violations, in which case the interval can stretch to three years. Subsection 7(2) authorizes five inspection bases the City can use: an area basis covering a geographic zone at once, a complaint basis for violations reported within a reasonable time, a recurrent-violation basis for premises with a history of uncorrected problems, a compliance basis that can extend a certificate to the maximum renewal period once a property is brought into line, and a percentage basis setting a share of units in a multiple dwelling to be inspected before a certificate issues.
Section 6 ties inspection to occupancy: units cannot be occupied without a certificate of compliance, inspections must occur within 15 days of a written application, and a $20 per-unit inspection fee applies under Section 6(7), waived if the City is the direct cause of a missed inspection. Section 10 makes any Chapter 82-A violation a municipal civil infraction under Chapter 100, with fines up to $500 per violation and each day of a continuing violation counted separately.
Violations & Fines
An owner who blocks a scheduled inspection or operates without a current certificate of compliance faces a municipal civil infraction under Section 10, with fines of up to $500, plus costs, damages and injunctive orders authorized by Chapter 100. Each day a violation continues is charged as a separate infraction.
