Full Breakdown
Village of Hamburg Code § 123-12 puts complaint handling in the hands of the Code Enforcement Officer, who reviews and investigates complaints alleging conditions or activities that fail to comply with the Uniform Code, the Energy Code, Chapter 123, or any other local law adopted to administer those codes. The section does not name tenants, set a form, or print a phone number, so a renter, a neighbor, and an owner stand on the same footing. The response includes the steps the officer deems appropriate: an inspection with documented results, notice of the violation with an opportunity to abate, correct, or cure, a stop-work order where appropriate, and, once a violation is fixed, a follow-up inspection and a final written report filed with the complaint.
Section 123-11C(2) separately allows a fire safety and property maintenance inspection of any dwelling unit on receipt of a written statement alleging that conditions failing to comply with the Uniform Code or Energy Code exist. Under § 123-11C(3), nothing permits an inspection where a court order or warrant is required unless it has been obtained.
If a violation is confirmed, an order to remedy under § 123-17A must be in writing, signed by the Code Enforcement Officer, specify the violated provisions, and require full correction within 30 days of the order. It can also direct protective steps such as vacating the building or barricading the area, and it is served on the owner personally or by registered or certified mail within five days of the order. Buildings in imminent danger are routed to Chapter 127 under § 123-9. For guests of short-term rentals, § 250-23.22B(2)(c) requires an owner or manager contact available 24/7 to respond to complaints filed by tenants, neighbors, and Village personnel, and § 250-23.22G(9) requires that person to respond within 30 minutes of notification. Code enforcement for the Village comes from the Town of Hamburg Building Inspection Department under the shared services agreement, unless the Village designates its own officer (§ 123-3A).
Violations & Fines
A confirmed violation of Chapter 123 carries a fine of not more than $250 per day of violation, or imprisonment not exceeding 10 days, or both, plus a civil penalty of not more than $250 for each day or part thereof (§ 123-17C). Disobeying an order issued by the Code Enforcement Officer is itself a violation, and the Village can seek an injunction in court, but only with authorization from the Board of Trustees of the Village of Hamburg (§ 123-17D).
