Full Breakdown

" If a property does not substantially conform, § 162A-6B requires the Building Inspector to refuse the certificate and demand the owner bring the property into compliance first. A certificate lasts three years under § 162A-6C, and the owner must apply for a new rental permit within 90 days before it expires. Section 162A-6D gives the Code Enforcement Officer discretion to void an existing certificate if later-discovered violations affect substantial compliance, and in that event can order occupants to vacate, with an emergency situation allowing an immediate vacate order.

An owner denied or facing revocation of a certificate can appeal in writing to the Board of Zoning Appeals under § 162A-6E, which holds a hearing where the burden falls on the appealing owner to show the Building Inspector's determination was arbitrary, capricious, or in excess of authority.

Violations & Fines

Renting a property that does not substantially conform to the Uniform Code, Zoning Ordinances or Property Maintenance Law is grounds for the Building Inspector to refuse or void a certificate of compliance under § 162A-6, order occupants to vacate under § 162A-6D, and pursue correction of violations under § 162A-10, backed by the § 162A-12B penalty of up to $1,000 and/or 15 days imprisonment per day of continued noncompliance.
