Toledo, OH Rental Property Rules: Repairs & Habitability (2026)

Under Toledo Municipal Code Chapter 1763, once a rental dwelling has been issued orders under the Toledo Municipal Health and/or Housing Code, the owner must apply for and obtain a Certificate of Property Code Compliance (CPCC) from the Commissioner of Building Inspection before renting or conveying any interest in the unit, and must do so within thirty days of failing to comply with the orders (§ 1763.02). The CPCC application must name a Registered Inspector who is certified by the State of Ohio or the Ohio Building Officials Association and registered with the Division of Building Inspection for a $25 annual fee (§ 1763.04).

The inspection covers electrical, heating and plumbing systems and the building structure, roof, gutters, siding, for safety and habitability, and must be filed with the Commissioner within thirty days of application. The owner then has ninety days to complete repairs and file the inspection report, extendable by one additional ninety-day period at the Commissioner's discretion (§ 1763.03(a)-(b)). The Commissioner issues the CPCC only after proof of inspection for each unit and proof the deficiencies were corrected or the property found compliant; the certificate expires three years after issuance, subject to annual inspection to stay valid, and can be voided sooner if the property is fire-damaged, vandalized, stripped or becomes structurally unsound (§ 1763.03(c)-(d)). A CPCC denial can be appealed to the Board of Nuisance Abatement/Housing Appeals under Chapter 1726 (§ 1763.03(e)).
