Toledo, OH Right to Farm: Agricultural Zoning Protection (2026)

Toledo Municipal Code § 1104.2400 (added by Ordinance 158-18, effective April 24, 2018) covers community gardens, composting, agricultural buildings, and urban agriculture as defined at §§ 1116.0202 and 1116.0119.1. A pure home garden tied to a principal residential use is exempt from these regulations, except for the composting standards of § 1104.2405. For everything else, § 1104.2401 requires unenclosed garden areas to sit at least 3 feet from any property line (subject to sight-distance setbacks), with structures on a principal-use urban agriculture site following the underlying district's setback table (§ 1106.0100) and structures on an accessory site following § 1105.0201.

Section 1104.2402 requires legal access to a water source, not necessarily on-site, and rain barrels or cisterns are allowed. Section 1104.2403 bars stormwater, irrigation runoff, chemicals, dirt or mud from draining onto neighboring properties or the public right-of-way. Structural allowances are generous but capped: greenhouses, hoop houses, cold frames and similar buildings reasonably related to gardening need only a Certificate of Zoning Compliance provided each stays under 400 square feet and 20 feet in height (§ 1104.2404). On-site sales are permitted too, 'Minor Agriculture' farm stands up to 100 square feet, portable enough to bring indoors, selling only what's grown on site between 8 a.m. and 8 p.m.; 'Major Agriculture' stands follow the same hours but require a Special Use Permit (§ 1104.2406).
