Davie, FL Short-Term Rentals: Host Presence Rule (2026)

Davie's ordinance does not mandate host presence; unhosted, whole-home vacation rentals are allowed. What the code requires instead is a designated responsible party. Under Sec. 16-153(a)(3) the application must list the responsible party's name, address, email, and emergency contact number, and Sec. 16-156(c)/(d) require that contact to be posted inside the unit. The town's registration materials specify that the owner or responsible party must be available by phone 24 hours a day, seven days a week to respond to police, fire, code enforcement, or other emergency requests, and must have authority to take affirmative action within one hour on life-safety, noise, and parking violations. Failure to respond can subject the owner to a fine of up to $1,000 per violation per the application terms. Owner presence is relevant only as a benefit: Sec. 16-156(b)(2) exempts owner-occupied vacation rentals from the gathering cap when the owner is physically present. The state framework supports a remote-management model — Fla. Stat. Sec. 509.032(7) lets towns require a local responsible party and contact information but bars them from effectively prohibiting rentals by demanding on-site hosting.
