Failure to respond can subject the owner to a fine of up to $1,000 per violation per the application terms. Owner presence is relevant only as a benefit: Sec. 16-156(b)(2) exempts owner-occupied vacation rentals from the gathering cap when the owner is physically present. The state framework supports a remote-management model — Fla. Stat. Sec. 509.032(7) lets towns require a local responsible party and contact information but bars them from effectively prohibiting rentals by demanding on-site hosting.
If the owner/responsible party cannot meet the 24/7 availability and one-hour response standard, the owner is subject to a fine for each violation (up to $1,000 per the application's responsible-party terms), and the certificate of compliance may be suspended or revoked.
