Davie vacation rentals must comply with the town's general Noise code (Chapter 15). Amplified music, radios, and similar devices that create a noise disturbance across a property line are prohibited between 7:00 p.m. and 7:00 a.m. Owners must give guests a copy of Chapter 15 and a responsible party must respond to noise complaints within one hour.
Davie does not impose vacation-rental-specific quiet hours; instead Article IX folds rentals into the town's general Noise code, Chapter 15. Sec. 16-153(a)(5) requires the owner to acknowledge that it is unlawful to make noise as set forth in Chapter 15 and to provide each transient occupant a copy of Chapter 15. Under Sec. 15-7, specific prohibitions include operating any radio, television, musical instrument, sound amplifier, or similar device that creates a noise disturbance across a real property boundary between 7:00 p.m. and 7:00 a.m. the following day, and creating a noise disturbance at 50 feet from a device in or on a motor vehicle. The town's vacation-rental materials also require posting a notice respecting neighborhood peace and prohibiting excessive or boisterous noise inside or outside the dwelling. The responsible party must respond to noise complaints and take affirmative action within one hour of notice from the town (Sec. 16-156(c) and the registration's responsible-party requirements). Local noise regulation is expressly preserved under Fla. Stat. Sec. 509.032(7), which preempts duration/frequency rules but lets towns enforce generally applicable noise ordinances against vacation rentals.
A noise disturbance across a property boundary in the restricted hours violates Chapter 15 and Article IX. Police or Code Enforcement may cite the owner, responsible party, or guest; penalties run up to $500 per violation (Sec. 16-160), with each day a separate offense.
