Full Breakdown

Town of Davie Code § 16-156(b) sets a firm overnight cap of two transient occupants per sleeping room, with the sleeping room count confirmed by an on-site town inspection. Daytime or evening gatherings at the property cannot exceed one and one-half times the certified overnight occupancy and, in no event, more than 20 people, unless the owner is physically present, in which case the gathering cap does not apply. Up to four children under age 13 are excluded from both the overnight and gathering counts.

Violations & Fines

Exceeding the certified occupancy or gathering cap is a violation of Article IX, treated as a single violation per rental period, enforceable by citation and civil penalty up to $500 per violation under § 16-160.
