Davie, FL Short-Term Rentals: Night Caps (2026)

Davie's Chapter 16, Article IX contains no minimum-stay, maximum-stay, or annual night-cap provision. The definition in Sec. 16-151 uses a 'less than 30 days' / 'more than three times a year' threshold only to decide what counts as a vacation rental — it does not limit how many nights or bookings are allowed. This is by design: Fla. Stat. Sec. 509.032(7) preempts local governments from prohibiting vacation rentals or regulating the duration or frequency of rentals, except for ordinances grandfathered on or before June 1, 2011. Because Davie's ordinance was adopted in 2021 (Ord. O2021-014), it cannot impose night caps, minimum-stay floors, or limits on the number of rental periods per year. Instead, Davie relies on registration (Sec. 16-152), annual renewal, life-safety standards, occupancy limits, parking, and noise rules to manage impacts. The only stay-related provision is the underlying trigger that property rented to transient occupants more than three times a year for periods under 30 days must register. Operators may rent as frequently and for as short a duration as the market allows, subject to the state DBPR license and the town's conduct standards.
