Indio's host-presence control is built around two roles rather than owner-occupancy. First, the RESPONSIBLE PERSON - the signatory on the rental contract - must, under Section 37.012(F)(2), execute an acknowledgment form confirming they are legally responsible for the conduct of all occupants and guests and that they must be present at the property during the entire short-term rental period. Section 37.012(E) requires the owner to collect an informational form from the responsible person listing their government ID, the names of all occupants, and all vehicle and license-plate information. Second, the owner must designate a LOCAL CONTACT PERSON who, under Section 37.002, must reside in the Coachella Valley and be available 24 hours a day, seven days a week. Section 37.012(H) requires that contact to respond to third-party complaints within 15 minutes if responding by telephone or text and within 45 minutes if an in-person response is needed; if the city itself calls or texts, the local contact must respond within 15 minutes, and within 45 minutes in person if the city requests it. Any complaint that occupants created unreasonable or unlawful noise or are engaging in disorderly conduct under Chapter 95 always requires an in-person response. The owner must also post the local contact's name and phone number and provide the responsible person with the contact's 24-hour information before occupancy (Section 37.012(F)(1), (G)).
Failing to designate or maintain a responsive 24-hour local contact, or missing the 15-minute/45-minute response windows, violates Section 37.012(H) and is enforceable under Section 37.019 as a misdemeanor or administrative citation, each day a separate offense. Renting without the responsible person present, or without collecting the required forms, violates Section 37.012(E)-(F) and can support permit suspension or revocation under Section 37.016.
