Indio short-term rentals must observe quiet hours from 9 p.m. to 8 a.m. Sunday-Thursday and 10 p.m. to 8 a.m. Friday-Saturday, during which no sound may be audible beyond the property line and outdoor amenities may not be used (Section 37.012(I)-(J)). Amplified music is never allowed outside the home, per Municipal Code Chapter 95C.
Section 37.012(I) of the Indio Municipal Code requires short-term rental occupants to comply with the Chapter 95C noise standards and prohibits any radio, instrument, loudspeaker, sound amplifier, or similar device from producing sound audible beyond the property line between 9:00 p.m. and 8:00 a.m. Sunday through Thursday and 10:00 p.m. and 8:00 a.m. Friday and Saturday. Any device that amplifies music inside the unit may not be heard beyond the property line at any time of day or night. Section 37.012(J) prohibits occupants from using outdoor amenities or engaging in outdoor games or activities that create noise, including amplified sound, during those same quiet-hour windows, and a sign stating the restriction must be posted near any spa or pool and on interior doors leading outside. Section 37.012(A) obligates owners and agents to use reasonably prudent business practices to ensure occupants do not create noise in violation of Chapter 95C or other disturbances. Section 37.012(H) requires the owner, agent, or local contact to be available 24 hours a day, seven days a week and to respond within 15 minutes by phone or text and within 45 minutes in person; any complaint of unreasonable noise or disorderly conduct under Chapter 95 requires an in-person response. The Permit Administrator may revoke a permit for a third noise- or permitting-related violation in a permit term (Section 37.016(B)).
Noise violations are enforced under both Chapter 95C and Chapter 37. A violation of Chapter 37 is a misdemeanor punishable under Chapter 12, or may be cited administratively, with each day a separate offense (Section 37.019). The owner or agent may immediately terminate occupancy for creating a disturbance (Section 37.012(G)(5)), and a third noise- or permit-related violation in a term is grounds for revocation under Section 37.016(B).
