So a host whose guests throw a loud late-night party can be addressed under the same noise rule as any neighbor. Hosts commonly include quiet-hours language in their house rules to reflect the 11:00 p.m. cutoff. Outside quiet hours, unreasonable noise can still be charged as disorderly conduct under Section 08-01-27.
Loud or offensive noise from an STR plainly audible 150 feet from the source between 11:00 p.m. and 7:00 a.m. violates Section 07-13-03 and can be abated under the city's nuisance procedures (Section 07-11-05), where a continuing noticed nuisance is a misdemeanor and each day may be a separate offense.
