Scottsdale limits STR overnight occupancy to a maximum of 6 adults or 2 adults per bedroom, whichever is less, plus their minor children. This strict occupancy limit was adopted under Ordinance 4566 to address party house concerns in residential neighborhoods.
Scottsdale's STR occupancy limits are among the strictest in Arizona. Under Ordinance 4566, overnight occupancy is capped at the lesser of: 6 adults total, or 2 adults per bedroom. Minor children of the occupants are not counted in the limit. These limits address the party house problem that prompted much of Scottsdale's STR regulation. The occupancy limit must be clearly stated in rental listings and guest agreements. The Emergency Point of Contact is responsible for ensuring compliance. Nuisance party ordinance (Chapter 19) provisions also apply to STR gatherings that exceed occupancy limits or create noise disturbances. Daytime visitor numbers are not explicitly capped but must not create nuisance conditions.
Exceeding occupancy limits may result in fines: $500 first offense, $1,000 second offense, $2,000 third offense with possible license suspension or revocation within 12 months.
