The City of Waco regulates short-term rental and bed and breakfast facilities under Chapter 13, Article VIII (Sections 13-470 and 13-471). Maximum occupancy is set at 2 adults per bedroom plus 2 additional adults per rental unit, applied across all four STR categories (BBHE, B&B Inn, STR Type I, STR Type II) and STR Type III multi-family units. In the R-E (Residential-Estate), R-1A, R-1B, and R-1C single-family zoning districts, a Bed and Breakfast Homestay Establishment, Short Term Rental Type I, or Short Term Rental Type II may not be occupied by more than 4 individuals unrelated by blood, marriage, or adoption at any given time, which can be more restrictive than the per-bedroom calculation. The assigned occupancy limit and license number must be prominently displayed in all marketing materials, advertisements, and online listings (Airbnb, VRBO, Booking.com). Operators must also obtain a City of Waco STR license from Planning Services and, in some categories or zones, a Special Permit before the license is issued. Bed and Breakfast Homestay Establishments are limited to 5 guest rooms; Bed and Breakfast Inns are limited to 15 guest rooms.
Operating over the posted occupancy limit, exceeding the 4-unrelated-person cap in R-E/R-1A/R-1B/R-1C zones, or failing to display the license number and occupancy limit in listings can trigger code enforcement, citations, and license revocation. Repeat violations may bar future license renewals.
