San Clemente STLUs must provide all parking on site. Off-street spaces used to calculate maximum occupancy must stay unobstructed and accessible during every rental. Spaces must meet the Zoning Ordinance minimum stall size of 9 by 19 feet.
STLU permit condition 3 requires all parking be provided on site, and any spaces used to calculate the maximum renters and guests for an STLU (including STARs) be maintained unobstructed and accessible at all times during a short-term rental. The zoning-permit application requires a site plan or aerial photograph showing the number and location of designated, legal off-street parking spaces (garage and driveway), and the Zoning Ordinance requires spaces to be 9 feet wide and 19 feet long. Because maximum occupancy is tied to parking capacity under SCMC 17.28.292.C.11, the count and size of legal off-street spaces directly determine how many overnight renters the license allows. The maximum vehicle count is disclosed in the 300-foot neighbor notice.
Blocking or obstructing the off-street spaces used to calculate approved occupancy violates condition 3. Because occupancy derives from on-site parking, losing accessible spaces reduces the lawful renter count. Parking complaints go to Code Enforcement; unresolved violations can support revocation.
