Lake Elsinore does NOT require a short-term rental to be the host's primary residence. Chapter 5.86 permits non-owner-occupied whole-home rentals in all residential zones, requiring only that the owner hold the license; ADUs are barred and CC&Rs or deed restrictions may still prohibit a rental.
Unlike cities that limit short-term rentals to a primary residence, Lake Elsinore's Chapter 5.86 has no primary-residence or owner-occupancy requirement. LEMC 5.86.040 permits short-term rentals in all residential zones if the owner holds the license, pays TOT, and meets the operational rules, with no requirement that the owner live on-site. Owner is the title holder, excluding a lessee. The practical limits on investor use are: ADUs may not be short-term rentals (LEMC 5.86.040(E), 17.415.110, Gov Code 66323); only the habitable interior may be rented; the owner must affirm the use is allowed under any CC&Rs; and a deed restriction prohibiting short-term rentals controls, with the City declining to override it (LEMC 5.86.070(F)).
There is no penalty for a non-primary-residence short-term rental because Chapter 5.86 permits it. However, operating an ADU as a rental, or renting where CC&Rs or a deed restriction forbid it, can lead to revocation plus fines up to $5,000.
