For any dwelling over five bedrooms, the maximum still may not exceed 12 persons. A bedroom (LEMC 5.86.020) is a permanent room of at least 100 square feet with four walls, a door, and a closet. The Director may approve a higher number for unusual size; if a permit sets a lower limit, the permit governs. Guest includes overnight occupants and daytime visitors. The rental is for overnight lodging only and may not host weddings, parties, or commercial functions (LEMC 5.86.090(H)); the primary guest must be 21 or older.
Exceeding the bedroom-based guest limit, or hosting a prohibited party or event, violates LEMC 5.86.090 and is enforceable by citation, infraction, misdemeanor, or nuisance abatement. Fines reach $1,500, $3,000, and $5,000, with each day a separate offense (LEMC 5.86.140).
