Lake Elsinore, CA Short-Term Rentals: Occupancy Limits (2026)

Section 5.86.090(L) of the Lake Elsinore Municipal Code requires every short-term rental owner to limit occupancy to a specific number of guests set by a bedroom-based table printed in the code: a studio or zero-bedroom unit is capped at 2 guests, a one-bedroom at 4, two bedrooms at 6, three bedrooms at 8, four bedrooms at 10, and five bedrooms at 12. For any dwelling with more than five bedrooms, the maximum stays fixed at 12 persons; the code does not scale upward beyond that ceiling.

Where the individual short-term rental business license itself sets a lower cap than the table, the stricter permit limit controls. The Director may approve a higher overnight-guest maximum only where unusual size, interior layout, parking or other physical characteristics justify it, and only as part of the license application or renewal process, not on request afterward. These caps interact with other operational rules in the same section: the primary guest must be an adult at least 21 years old who is reachable by phone at all times (§ 5.86.090(I)), and every lease must disclose the maximum guest count along with a notice that exceeding it is a violation of the chapter (§ 5.86.090(O)(1)).

Advertising for the rental is likewise restricted to the licensed maximum occupancy figure under § 5.86.100(B), so a listing cannot market more sleeping capacity than the permit allows.
