Lake Elsinore restricts amplified music, loudspeakers, and sound-amplifying equipment under LEMC 17.176.080(A) and (B). They may not create a noise disturbance across a residential property line, especially between 10 p.m. and 7 a.m., absent a city variance.
LEMC 17.176.080(A) bars operating any radio, television, phonograph, drum, musical instrument, or similar device between 10:00 p.m. and 7:00 a.m. so as to create a noise disturbance across a residential or commercial property line, or at any time exceeding the Table 1 exterior limits in LEMC 17.176.060(A). LEMC 17.176.080(B) similarly restricts any loudspeaker or sound-amplifying system between 10 p.m. and 7 a.m., except noncommercial public speaking or assembly for which a city variance is issued. On a public right-of-way or public space, devices may not exceed the public-space level measured 50 feet away (17.176.080(A)(2)). The Noise Control Officer may grant variances up to 365 days (LEMC 17.176.110).
Amplified-sound disturbances are public nuisances. Per LEMC 1.16.010, infractions are $100/$200/$500; otherwise a misdemeanor up to $1,000 or six months.
