Lake Elsinore, CA Noise Ordinances: Aircraft Noise (2026)

Lake Elsinore regulates aircraft noise through two separate chapters. Chapter 9.48, adopted in 1981, makes it unlawful under § 9.48.010 to operate any aircraft, including an ultralight vehicle or motorized hang glider, within or above the City in violation of Federal Aviation Regulations Part 91 (General Operating and Flight Rules) or Part 101 (moored balloons, kites, ultralight vehicles, unmanned rockets and free balloons); the City enforces the federal flight rules rather than writing its own decibel standard for aircraft in flight. The separate noise ordinance, Chapter 17.176, reaches ground-based aircraft noise instead.

Section 17.176.090(E) bars repairing, rebuilding, modifying or testing any motor vehicle, motorboat or aircraft in a manner that creates a noise disturbance across a residential real property line, or that at any time violates the exterior noise limits fixed in § 17.176.060(A) and Table 1: 40 dBA at night (10:00 p.m. to 7:00 a.m.) and 50 dBA by day for single-family residential receiving property, measured at the property line by the Noise Control Officer. Section 17.176.090(E)(2) exempts the actual movement of aircraft conducted in accordance with federal law, so a plane flying overhead under FAA rules cannot be cited under the local noise chapter; only ground repair and testing noise is reachable locally. Section 17.176.100(J) reinforces that any activity preempted by state or federal law is exempt from Chapter 17.176 entirely.
