040(a) authorizes the public works director, on written application, to grant a revocable permit for planter boxes, planting areas, bicycle parking and associated benches on public sidewalks, and for awnings and similar building appurtenances that project over the sidewalk, but only if the director finds the installation does not obstruct or make hazardous the public's use of the sidewalk and street. The section carves out an exception for food and beverage establishments using urban open spaces under the city's Downtown Outdoor Dining Program, which are handled separately.

Awnings, signs and similar appurtenances additionally need approval from the fire department and the community development and sustainability department, and the director can set clearance and projection standards that must be at least as strict as the Uniform Building Code. Portable sign permits require community development and sustainability department sign-off that the size, materials and placement meet the zoning ordinance, plus proof the sign will not obstruct sidewalk use, and the owner must carry insurance and indemnify the city; the approved permit's evidence must be displayed on the sign itself. Any permit can require the permittee to remove the encroachment at their own expense if it is not properly maintained. 35 of Chapter 40.
