East Orange, NJ Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

East Orange City Code Chapter 238, Article IV requires a Public Works permit before anyone places, constructs, erects or maintains any obstruction or encroachment on, over or under a street, sidewalk or public place, and the list of covered items expressly includes building materials, projections from buildings, utility wires, canopies and vaults. To get the permit, the applicant must first deposit with the Collector of Taxes $0.50 per square foot of the street, sidewalk, crosswalk or other public place to be obstructed, with a minimum deposit of $20; that deposit is refunded once the Director of Public Works certifies the space has been cleared and restored.

On top of the deposit, applicants must pay a separate, nonrefundable permit fee of $0.10 per square foot before the Director will issue the permit. The Director sets whatever conditions are necessary to protect public health and safety, specifies the permit's term, and can revoke it for cause on 30 days' notice, as can the City Council. Between sunset and sunrise, the permit holder must place warning lights on temporary obstructions as the Director specifies. Physical clearance is also fixed by code: no awning, canopy or other encroachment over a sidewalk may hang lower than seven feet above the sidewalk surface, and nothing over a street may hang lower than 16 feet above the street.
